Gordon Silver Ltd. is pleased to announce that shareholder Paola M. Armeni, a shareholder in our Government Investigations and Business Crimes group, recently received an affirmation from the 9th Circuit Court on a $1.6 million dollar judgment against the Las Vegas Metropolitan Police Department.
In review of the evidence presented by Ms. Armeni, two 9th Circuit panels rejected the officers’ contention that their conduct was objectively reasonable. The Court stated “a reasonable officer would have known it violated clearly established law to use a choke hold on a non-resisting arrestee who had surrendered, pepper-spray him, and apply such knee pressure on his neck and back that it would cause the collapse of five vertebrae in his cervical spine.” The case was allowed to proceed to trial, where the client received a substantial verdict.
Though the Las Vegas Metropolitan Police Department appealed, the U.S. Court of Appeals, 9th Circuit panel of judges noted, “...the jury had found…that the officers used an unreasonable amount of force and the officers failed to meet the relevant burden necessary to overturn the finding.”
Upon receiving the opinion notice, Ms. Armeni said “Justice has prevailed in this case.” “Citizens must be confident in the protection of their rights and not have to be scared to open the door to a police officer,” says Armeni.
The client will finally receive over $1.6 million for his medical damages and pain and suffering.
